Being in a car accident can be scary, but it’s important to plan ahead and be prepared. Below are nine steps that should be taken if you have been involved in an auto accident.
1) Stay at the scene and remain calm
- The general rule of thumb is never leave the scene unless it is appropriate to do so. If you leave, you may be charged with a “hit and run.”
- Move as far off the roadway as possible for safety reasons, but remain at the scene of the accident.
- Warn oncoming traffic by activating your hazard warning lights.
2) Check on all drivers and passengers
- Check to make sure everyone involved in the accident is okay. If necessary, get medical attention for anyone who may need it.
3) Call the Police
- If the accident involves bodily injury and/or significant property damage, you should call the police.
- Ask that a police report be filed, obtain the name and badge numbers of any responding officers.
4) Do NOT apologize or admit guilt
- An auto accident scene can be chaotic and it might not be evident who is at fault, or who was more at fault, in causing the accident. Be cordial and cooperative, but do not apologize or admit guilt.
- Report the car accident to the police when they arrive.
5) Exchange information
- Talk to the drivers of any other vehicles involved in the accident. Obtain their name, phone number, address, drivers’ license numbers, license plates numbers, and basic insurance information.
- If there are passengers in any of the vehicles, obtain their names, telephone numbers, and addresses as well.
6) Take pictures
- If possible, take photographs of any damage to your vehicle as soon as possible after the accident. Take pictures of damages to any other vehicles involved in the accident as well.
7) Talk to witnesses
- If there are witnesses present, get their names, telephone numbers, or addresses if possible.
- Write down what they tell you and provide the information to your attorney.
8) Keep track of repairs and seek medical treatment if you are injured
- It will be better in the long run if you keep track of repairs and any medical treatments.
9) Consider hiring a personal injury attorney
- If there are injuries or extensive property damage involved, you should consider hiring an experienced attorney to help you.
- An attorney can help you protect your rights; obtain the maximum compensation you deserve; and allow you to focus on your recovery instead of worrying about medical bills and lost wages.
