Things You Need To Know About Contracts

Contracts are entered into every day for business and personal reasons.

Some of these contracts are written, while others are oral. In every case, it is important that the terms of the contract are fairly negotiated, properly drafted, and reviewed to ensure the contract meets the intentions of the parties.

  1. Every business enters into contracts. Most businesses actually enter into contracts every day. Many are verbal, or entered into by email. It can be difficult to be sure what you have agreed to.
  2. It is important that business contracts are set out in writing to protect you and the other party. You can set up standard ones to make it easy to provide a written contract quickly. For example, your business can have a standard sales, employment, contractor, and license agreements.
  3. A contract is usually structured with the operative or business-specific clauses at the beginning of the document. The more standard “boilerplate” clauses that address general legal issues are usually at the end of the document. Generally, the majority of the time spent drafting or reviewing and negotiating it will be spent on the operative or business-specific clauses.
